Draft. This text is a plain-English starting point, not legal advice.
These Terms of Use ("Terms") are an agreement between you and [COMPANY LEGAL NAME] ("we", "us"), the company behind Slush Fund. They cover the Slush Fund game, this website and our official channels (together, the "Service").
1. Agreeing to these terms
By creating an account, playing the game or using this website, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. 18 and over only
The Service is only for people who are 18 or older. By using it, you confirm that you are. We may close any account we believe belongs to someone under 18.
3. Accounts and conduct
You are responsible for your account and for keeping your password secret. Tell us at [EMAIL] if you think someone else has used it. Each account may be in one live game at a time, and accounts are personal: don't sell, share or transfer them.
When you use the Service, you agree not to:
- break the law, or harass, threaten or impersonate anyone, including our team;
- cheat, exploit bugs, or use bots, scripts or modified clients;
- attack, overload, probe or reverse engineer our servers or the game, except as allowed by law or by our published bug bounty;
- scam other players, or use our name to promote fake tokens, airdrops or giveaways.
4. Fair play, anti-cheat and bans
The game server decides the outcome of every match, and we run checks to spot cheating. If we reasonably believe you have cheated or broken these Terms, we may remove scores or ratings, suspend your account, or ban it permanently. Where we can, we'll tell you why. If you think we got it wrong, email [EMAIL] and we will review it.
5. User names
User names must be 3 to 16 letters, numbers or underscores. Don't pick a name that is offensive, hateful, sexual, misleading or that impersonates someone else, including a real person, a brand or our staff. Names are filtered and players can report them. We may change or remove any name that breaks these rules.
6. Virtual cosmetics
- License, not ownership. Weapons and cosmetics you earn or buy give you a personal, limited, revocable license to use them in the game. You don't own them.
- Purchases. Weapons, cosmetics and weapon skins may be sold. A bought weapon is the same weapon players earn in play, with the same numbers; nothing you buy adds hearts, damage or speed, and nothing you buy earns prize points or leaderboard position. What each item is will be shown before you buy. Prices are in US dollars, and you pay with SOL or USDC on Solana; card payments aren't accepted. All purchases of weapons, weapon packages, perks, cosmetics, skins, wraps, bundles, passes and collector items are final and non-refundable once the item is delivered to your account. A payment that doesn't complete a purchase (a wrong, short, duplicate or late on-chain payment) is refunded automatically, in the same coin, to the wallet it came from.
- No cash value. Cosmetics can't be exchanged for money or anything of value, and can't be traded, sold or transferred.
- Refunds follow [REFUND POLICY] and any rights you have under the rules of the app store you paid through and applicable law.
- We may change or retire items, and if the Service closes your license ends. Nothing here limits refund rights the law gives you.
7. The $SLUSH token is separate
Crypto is high risk. You can lose all the money you put in.
$SLUSH is an optional token on the Solana blockchain. You never need it to play, and it is separate from your game account and cosmetics.
- No promise of value. We make no promise that $SLUSH will have or keep any value, or that anyone will buy it from you.
- Not an investment. $SLUSH is not a share, security, fund, or a claim on our revenue or assets. It pays nothing, and there are no buybacks. Don't buy it hoping to make money.
- High risk. Crypto prices swing wildly, and blockchain transactions can't be reversed. You may lose all the money you put in.
- Not available everywhere. The presale and any token features are not offered where they are prohibited, and it is your responsibility to follow the laws where you live.
- Age. Presale buyers must be 18 or older. We may refuse or reverse participation that breaks these terms or the law, where we are able to.
- Your wallet, your keys. We never hold your wallet or keys and can't recover lost funds or reverse a transaction.
Presale terms (limits, payment, timing and refunds if the minimum isn't reached) are set out in our docs and the checkout, and [PRESALE TERMS — TO CONFIRM]. Nothing on the Service is financial advice, an offer to sell, or a solicitation.
8. Our content
Slush Fund, its characters, art, code, music, names and logos are original work owned by or licensed to [COMPANY LEGAL NAME]. You may share screenshots and clips of your own play, and press may use the assets in our press kit. Otherwise, don't copy, sell or build on our content without written permission.
Slush Fund is not affiliated with, endorsed by or connected to any TV show or network.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including that it will be uninterrupted, error-free or secure. Matches may lag, servers may go down, and snowballs may occasionally phase through a mailbox. We are not responsible for third-party wallets, blockchains, exchanges or app stores.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost revenue, data or crypto. Our total liability for any claim about the Service is limited to the greater of the amount you paid us for cosmetics in the 12 months before the claim, or [LIABILITY CAP AMOUNT]. Some states don't allow these limits, so they may not all apply to you.
11. Governing law
These Terms are governed by the laws of the State of [STATE] and applicable US federal law, without regard to conflict-of-law rules.
12. Dispute resolution
If you have a problem, please email [EMAIL] first; most things can be fixed that way. If we can't resolve it within 60 days, disputes will be handled by [ARBITRATION CHOICE — TO CONFIRM]. [CLASS-ACTION WAIVER, SMALL-CLAIMS EXCEPTION AND OPT-OUT WINDOW — TO CONFIRM].
13. Changes
We may update these Terms. We'll change the date at the top, and for significant changes we'll tell you in the game or by email before they take effect. If you keep using the Service after that, you accept the new Terms. We may also change, pause or end any part of the Service.
